Commission’s Memorandum of Understanding with Parliament
On Thursday 28 November 2024, a memorandum of understanding (MOU) signed by the Commissioner, the Attorney-General, the President of the Senate, and the Speaker of the House of Representatives was tabled in Parliament. The MOU relates to the exercise of the Commission's investigative powers where parliamentary privilege may be involved.
The MOU details various contexts where the Commission may come into possession of potentially privileged material, including by covert collections, search warrants, and notices to produce. While the MOU focuses on material captured directly via a Parliamentarian or their staff, it extends to material that is captured outside of this context, for example from a third-party provider that holds privileged material.
These agreed processes are intended to ensure that parliamentary privilege is respected, while permissible action by the Commission to detect and investigate corrupt conduct is not inhibited.
The Commission acknowledges the contributions of the President, the Speaker of the House, the Clerks of both Houses, the members of the Parliament’s MOU Working Group, and the Attorney-General, in negotiating the MOU.
