The Commission may deal with reports and referrals in a number of ways. This includes deciding to take no action. 

If you are dissatisfied with the way the Commission decides to deal with your referral, you can apply for a review of the decision. 

Applications for reviews of decisions will be accepted within 3 months of the original decision. An application made more than 3 months after the original decision must demonstrate why it should be permitted, including an explanation for the delay. 

An application for a review must explain why you are dissatisfied with the decision that was made or the actions taken in relation to your matter and identify what you say are the errors in the decision. 

It is important you are familiar with the jurisdiction of the Commission and the elements of corrupt conduct in making a request for review. 

The Request for Review form asks you to state: 

  1. Our reference number – so that we can easily and accurately identify your original report. 
  2. What is the date on the correspondence notifying you of the decision? 
  3. Why you are applying for a review (free text field).

Noting that a review will only proceed if there is a valid reason for a review, you may wish to include answers to the following questions:

  • Do you disagree with whole or a part of the decision. If a part, which part? 
  • If you think there is a material error of fact or law in the original decision, specify each error and why it is wrong
  • If you think the decision failed to have regard to relevant considerations or evidence, please specify what you say was not taken into account
  • If you think there was incorrect process in making the decision, explain what was wrongly done or omitted
  • If you have fresh evidence not available at the time of the original submission or decision, summarise that evidence and attach it.

4. Please attach any new information you would like to provide about your matter that may affect the decision. The form allows for up to 2 attachments of up to 5MB each.

All review applications are carefully assessed by a staff member who has not previously been involved in a decision on the matter. They will decide if there is a valid reason for a review. Valid reasons for a review can include a material error of fact or law in the original decision, failure by the decision-maker to have regard to relevant considerations or evidence, incorrect process in making the decision, and fresh evidence not available at the time of the original submission or decision.
